How to Report Copyright Infringement

If you believe that content available on or through our Services infringes one or more of your copyrights, please submit a written notification ("DMCA Notice") containing the following information, as required under 17 U.S.C. § 512(c):
  • Your physical or electronic signature (or the signature of a person authorized to act on your behalf).
  • Identification of the copyrighted work(s) that you claim have been infringed. If multiple copyrighted works are covered by your notice, you may provide a representative list.
  • Identification of the material that you claim is infringing, and information reasonably sufficient to permit us to locate the material (e.g., a URL or detailed description).
  • Your contact information, including your name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Response Process

Upon receipt of a valid DMCA Notice, HammerAI will:
  • Promptly investigate the claim.
  • Remove or disable access to the allegedly infringing material.
  • Notify the user who posted the material that it has been removed.
  • Provide the user with information about submitting a counter-notice.
  • Take appropriate action against repeat infringers, including account termination.

Counter-Notice Procedure

If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to us containing the following:
  • Your physical or electronic signature.
  • Identification of the material that was removed or to which access was disabled, and the location at which the material appeared before it was removed or access was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, mailing address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal court in your district (or, if you are outside the United States, that you consent to the jurisdiction of any judicial district in which HammerAI may be found), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.

Upon receipt of a valid counter-notification, HammerAI will forward it to the original complainant. If the original complainant does not file a court action within 10 business days, HammerAI may restore the removed material.

Repeat Infringer Policy

HammerAI will terminate the accounts of users who are determined to be repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than twice and/or has had content removed from the Services more than twice. HammerAI reserves the right to terminate any account at its sole discretion, with or without notice, for actual or suspected copyright infringement.

AI-Generated Content

Please note that much of the content available on HammerAI is generated by artificial intelligence. AI-generated content generally lacks substantial human authorship and, under current U.S. Copyright Office guidance, may not be eligible for copyright protection. DMCA notices should be directed at content that infringes on existing copyrighted works, not at AI-generated outputs that may coincidentally resemble copyrighted material.

Legal Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer, the copyright owner or its licensee, or the service provider.
